Building Consent Exemptions in New Zealand

Some low-risk building projects in New Zealand may not require a building consent, provided they meet the exemption criteria set out in the Building Act 2004

Common exempt building types can include:

  •  Small standalone homes or granny flat
  • Sleepouts
  • Garages and sheds
  • Carports
  • Rural pole sheds and hay barns

Exemptions are subject to specific conditions relating to factors such as building size, use, location, height, design, structural requirements, and who carries out the work.

Even where a building consent is not required, all building work must still comply with the New Zealand Building Code and other applicable legislation, including local council planning rules and site requirements.

Requirements can vary depending on your site and project, so it’s important to confirm what applies before building.

For full details and current exemption criteria, visit the MBIE Building Consent Exemptions page.

Granny Flats and Small Homes

Certain small standalone homes or granny flats may qualify for a building consent exemption where they meet the required criteria.

These rules are intended to make it easier to add additional living space to a property, while still ensuring buildings are safe and compliant.

Garages, Carports, Sheds and Sleepouts

Some detached garages, carports, sheds and sleepouts may not require a building consent if they meet the exemption conditions.

Requirements can include limits on size, height, location and construction methods.

Talk to your local Versatile team to discuss the best option for your site and project.

Farm Buildings

Certain pole sheds and rural farm buildings may also qualify for consent exemptions when built within the criteria and conditions.
